National Fuel Gas Supply Corporation ("National") is extending the period of time within which tendered Precedent Agreements related to Open Seasons 129, 142 and 143 must be returned. With this posting, National is requiring that signed Precedent Agreements be returned not later than January 15, 2010.
This extension will provide shippers with sufficient time to review the agreement language. It will also afford them the opportunity to participate in National's planned binding open season for transportation capacity from its FM100/FM120/Line K systems to Leidy, PA.

    GENERAL INFORMATION:

    National Fuel Gas Supply Corporation (National Fuel) is pleased to announce the commencement of an Open Season for transportation capacity to Leidy and/or proposed interconnects with Millennium and Empire Pipelines. The purpose of this offering is to assess market interest for capacity from various available and proposed receipt points, including but not limited to a proposed Rockies Express interconnect at Clarington, Ohio as well a Local Production gas supply sources in the Appalachian region. Based on the Open Season requests, National Fuel will identify the required system enhancements and develop facility designs, cost estimates, and project economics.


    Expansions up to 500 mmcfd or more will be considered, and National Fuel will consider expansion of existing facilities as well as installation of new facilities to accommodate desired transportation paths.
    Participation in this Open Season is non-binding for bidders and National Fuel. The amount of awarded capacity will be at National’s discretion, depending on shippers’ aggregate level of interest and the economic viability of expansion(s).

OPEN SEASON TIMEFRAME:


Commencing March 19, 2007 and extending until 11:00 a.m. (Eastern Time) on May 24, 2007.

TERM:


Where expansion facilities are required, a minimum term of fifteen (15) years may be required.


COMMENCEMENT OF SERVICE:


Service for requested transportation paths that are available with existing facilities or minor system expansions may commence as early as November 1, 2008.

Service for requested transportation paths that involve more significant system expansions may commence as early as November 1, 2009.


RATE INFORMATION:


National Fuel will determine rates based upon shippers’ level of interest, and the projected costs associated with the required system expansion(s). National Fuel reserves the right to determine the economic viability of any required expansion(s).

BID AWARD PROCESS:


During the Open Season period, National will accept requests for transportation service commencing as outlined in the” Commencement of Service” section above. If National Fuel determines that the level of interest is sufficient to warrant an economically viable system expansion(s), then National Fuel will proceed to obtain the required customer agreements.
National Fuel will begin the negotiating of precedent agreements with individuals submitting a bid in this open season prior to any other party. If all capacity created by the proposed expansion is not initially subscribed to Open Season bidders, National Fuel reserves the right to market this capacity post-open season. National Fuel reserves the right to negotiate binding precedent agreements with any party submitting a post-Open Season request for service without an additional open season.
Although this is a non-binding open season, National Fuel reserves the right to negotiate Precedent Agreements that will obligate National Fuel and the successful bidder to execute a service agreement upon satisfaction of the conditions set forth in the Precedent Agreement. 

CREDIT REQUIREMENTS:

Shippers will be required to demonstrate creditworthiness or provide a credit alternative acceptable to National Fuel.

BID REQUIREMENTS:

All Open Season Requests must include a completed Service Request Form and Bid Sheet.  Both forms are available on our web site (www.nationalfuelgas.com), or by calling National Fuel's Interstate Marketing Department at (716) 857-7740.  The completed forms can be submitted online, via mail, or via fax.
